5 Important Facts about Employment Equity
- If your company has more than 50 employees (or a turnover above the designated threshold) you are required to have an Employment Equity Plan and report in line with the requirements of the act by 01 October.
- You are required to develop your Employment Equity Plan in consultation with your employees.
- The Employment Equity Commission is taking action against companies who fail to comply with the requirements of the Employment Equity Act.
- You are required to appoint a Senior Manager to ensure that Employment Equity is implemented within your organisation.
- The Department of Labour does random inspections to ensure compliance with the Act and fines (between R1.5 million to R2.7 million or between 2% – 10% of annual turnover) can be issued for non-compliance with the Act.
The purpose of the Employment Equity Act in South Africa is:
To promote equal opportunities and fair treatment to all in the workplace by eliminating unfair discrimination; and
To implement affirmative action measures to redress the disadvantages in employment experienced in the past by members from designated groups.

CHA will assist in all legal requirements for an effective warranted dismissal.
Disciplinary Procedure
According to the Labour Relations Act (LRA) any dismissal can only be effected for a fair reason and in accordance with a fair procedure.
Schedule 8 deals predominantly with the procedural elements of a disciplinary hearing – giving the employee fair opportunity to defend himself against any allegation of misconduct or incapacity in his position.
CHA can advise and counsel employers on relevant codes of good practice issued in terms of the LRA and / or draw up suitable company codes of conduct and disciplinary procedures in accordance with the requirements of the Act and protocols of the company.
Disciplinary Hearing
A Disciplinary hearing need not be as formal as a ‘mini court’, but should give the employee fair opportunity to defend himself in a language and format he can understand.
CHA can assist in all required criteria of a disciplinary hearing up to an including a fair dismissal if warranted.
